NOTICE OF COMPLAINT FOR AUTHORITY TO SELL REAL ESTATE REGARDING 520 S. WAYNE STREET, KENTON, OHIO 43326, HARDIN COUNTY, AUDITOR’S PARCEL NO. 24-090028.0000, CASE NO. 20241039, BRETT A. WALTERS, FIDUCIARY OF THE ESTATE OF DANA M. WALTERS, DECEASED, V. BRETT A. WALTERS, ET AL.

Mike Goodwin, person who is entitled to share in the estate of Dana M. Walters, decedent upon distribution, whose present address and residence is unknown, will take notice that on December 17, 2024, a Complaint was filed in the Hardin County Ohio Probate Court, One Courthouse Square, Suite 210, Kenton, Ohio 43326, being Case No. 20241039A in said Court against Brett A. Walters, et al, specifically including all the above noticed individual, further praying that the said Defendants claiming an interest in the real estate located at 2845 Heritage Place Ada, Ohio 45810, and described as follows: Situated in Liberty Township, Hardin County, Ohio. Being a parcel of land situated in the Northeast Quarter of Section 9, Township 3 South, Range 9 East, Liberty Township, Hardin County, Ohio, and being part of the K. Zimmerly land as described in Volume 107, Page 31 of the Hardin County Deed Records, More particularly described as follows: Commencing for reference at the southeast corner of the northeast quarter of section 9; thence north 00º 19’ 22” east, along the centerline of State Route 235 and the cast line of Section 9, for 654.54 feet to a P.K. nail found; thence south 90º 00’ 00” west for 641.48 feet to an iron pin found marking the point of beginning for the parcel to be described. (1) Thence from this point of beginning south 90º 00’ 00” west for 342.30 feet to a 1/2 inch iron pin set; (2) Thence north 00º 19’ 22” east for 656.45 feet to a 1/2 inch iron pin set; (3) Thence south 89º 36’ 08” east for 3425.30 feet to a 1/2 inch iron pin found; Thence south 00º 19’ 22” west for 654.08 feet to the point of beginning. Containing in all 5.149 acres of land, more or less, subject however to all legal easements and rights of way. Note: This plat and description prepared form an actual field survey made by or under the supervision of Thomas C. Hubbell, Registered Surveyor #5044. All bearings refer to the centerline of State Route 235 and the east line of Section 9 as being north 00º 19’ 22” east. Access is granted via an Easement for Right of Way dated November 5, 2001, and record in the Hardin County Deed Records Volume 280, Pages 2587 and 259. Be the same more or less, but subject to all legal highways, easements, and restrictions to use either apparent and/or of record and including subject to Heritage Place Site Restrictions. Prior Instrument Reference: Volume 343, Page 344. Permanent Parcel No. 24-090028.00, and/or a right to distribution thereof or therefrom be required to set forth any interest that said Defendants and individuals may have in the real estate, or be forever barred therefore, and all judicial declarations and determinations in said proceeding be final and conclusive of the right of all such parties and individuals with regards to the matter above referenced: and that the assets of the referenced Estate be distributed in accordance with such declarations and determinations thereafter, as well as for such other and further relief to which the Plaintiff is or may be entitled. Said Defendants and individuals will take notice that they are required to answer said Complaint within 28 days after the date of the last publication of this notice, or judgment will be rendered as prayed for against any such non answering Defendant or individual and the interest of said Defendants and individuals in said real estate assets and the distribution thereof and therefrom will be terminated/barred.
